Retrospective planning application for the retention of a garden fence at the side of the property and for the change of use of vacant land to a residential garden area

4D Planning's role

4D Planning liaised with the applicant's solicitor and the council to determine the best course of action to establish who the owner is of the land adjacent to the house. 4D Planning produced the drawings, statements, letters, advertised the application in the local media and submitted the application.

The client of an end of terrace property contacted us once the council sent them an enforcement notice to remove a garden fence (boundary wall). The challenge was that the garden fence was built without planning permission on land which was not owned by the client. The council did not own the land and neither did anyone else, therefore it was necassary to advertise the application proposal in the local press to consult and notify the public in case the owner steps forward to object. 4D Planning liaised with the applicant's solicitor and the council to determine the best course of action. Following intensive discussions the application was submitted to the council, the application was advertised and eventually the application was approved and the land is now in the ownership of the applicant.
