Certificate of lawfulness proposed for change within Class C3 from dwellinghouse (C3a) to supported housing (C3b) for up to five people.
4D Planning were instructed to prepare a lawful development application to confirm the lawfulness of the proposed use (C3b) at the property. The challenge was to convince the council that the proposed usage of the property would not fall under C2 use which requires full planning permission. We drafted a Planning Statement and managed the application with Hounslow Council. The application was approved and a Certificate of Lawfulness was issued.
This case study relates to a successful Lawful Development Certificate application for the change of use of an existing residential flat from Use Class C3(a) to Use Class C3(b) supported housing at Thames Works, Church Street, Chiswick, within the London Borough of Hounslow. The application was prepared and managed by 4D Planning on behalf of Shelter Community, a registered charity providing supported accommodation for young adults.
The proposal sought formal confirmation that the existing and proposed use fell within Use Class C3(b) and did not constitute development requiring planning permission under Section 55 of the Town and Country Planning Act 1990.
Use Class C3(b) allows for up to 6 individuals to live together as a single household while receiving care or support. In this case, the property was to be occupied by up to 5 residents aged 18 and over, living communally and receiving low level support from staff and volunteers. The accommodation included individual en suite bedrooms alongside shared kitchen, dining, and communal living areas, reinforcing the single household nature of the occupation.
The Statement of Purpose clearly set out how residents would live together, share facilities, and participate in communal activities, aligning fully with the legal definition of C3(b) rather than falling into sui generis or institutional use.
Pre-application advice from Hounslow Council confirmed that a change within Class C3 from C3(a) to C3(b) could be confirmed through a Lawful Development Certificate, provided sufficient evidence was submitted. The application therefore focused on demonstrating lawfulness rather than seeking discretionary planning permission.
This approach provides long term certainty for the operator and avoids unnecessary planning risk where the use is already lawful. It also means planning conditions and financial obligations for the new use will not be applicable, and planning policies will not be relevant, therefore saving a lot of time and cost.
The Statement of Purpose detailed the intended resident group, consisting of young adults affected by housing insecurity who do not qualify for local authority housing support. Residents were described as capable of independent living but benefiting from guidance with life skills, education, employment pathways, and social integration.
Support offered included coaching sessions, assistance with forms and appointments, communal meals with staff or volunteers, and general pastoral support. Importantly, the support model was clearly defined as low level and non institutional, reinforcing compliance with C3(b).
A significant focus of the documentation was safeguarding and community impact. The Statement of Purpose outlined comprehensive vetting procedures including background checks, risk assessments, and reference verification prior to residents moving in. Only individuals assessed as posing no risk to themselves, other residents, or the wider community would be accommodated.
Clear procedures were also set out for managing complaints, anti social behaviour, and emergency situations, including 24 hour on call management availability, CCTV in communal areas, and strict licence agreements linked to property rules.
Each resident would occupy the property under a licence agreement rather than a tenancy, supported by detailed property rules governing behaviour, noise, visitors, and use of communal areas. These rules were designed to protect both residents and neighbours and to ensure the property continued to operate as a stable single household.
Moving in and out of the property would be staggered, minimising disruption, and residents were not expected to own cars, meaning no material impact on parking or highways.
The property would be managed directly by Shelter Community, a registered charity established in 2013 with experience operating similar supported housing schemes. Regular review of safeguarding policies, staff DBS checks, and record keeping formed part of the management framework submitted with the application.
4D Planning acted as planning agent throughout the process, advising on the lawful development route, interpreting use class definitions, and preparing the Certificate of Lawfulness application. We coordinated closely with the applicant to compile robust evidence demonstrating that the proposed use met the legal tests for C3(b) and did not amount to development.
A detailed covering letter was prepared addressing the relevant legislation, previous permitted development approval at the site, and comparable C3(b) decisions secured by 4D Planning across London boroughs. This ensured the council had clarity on both the legal position and the practical operation of the use.
The submission of clear, structured evidence enabled the council to assess the proposal on a factual and legal basis. The Lawful Development Certificate confirms that the supported housing use is lawful for planning purposes, providing certainty for the charity and enabling the accommodation to operate without the risk of future enforcement action.
