Local Development Plan:
How important is the local development plan with regards to my planning application?
The Local Authority’s Development Plan is the primary consideration in Development Control in Managing Development:
“If regard is to be had to the development plan for the purpose of any determination to be made under the planning Acts, the determination must be made in accordance with the plan unless material considerations indicate otherwise”. [The PCPA 2004 s38 (6)]
However, there are other material considerations which can be given (more) weight in coming to a decision at the discretion of the planning authority.
